Job Description

The Massachusetts Gaming Commission (MGC) is seeking to hire an Attorney to work as Enforcement Counsel within the MGC’s Investigations & Enforcement Bureau (IEB). The IEB is the primary enforcement agent for regulatory matters under the Massachusetts gaming law (M.G.L. c. 23K) and sports wagering law (M.G.L. c. 23N). Under the direction of the Chief Enforcement Counsel, the Enforcement Counsel will work in conjunction with, and provide legal guidance, to members of the MGC’s civilian Gaming Agents Division (Gaming Agent’s Division), Sports Wagering Division, and the Massachusetts State Police Gaming Enforcement Unit (GEU) on regulatory matters. The Enforcement Counsel will also work collaboratively with the IEB's civilian Financial Investigations Division, the IEB's Paralegal(s), and the Commission's Licensing Division to reach well-reasoned determinations that comport with the legal and policy objectives of the gaming and sports wagering laws. Duties and Responsibilities include, but are not limited to the following:

  • Work in collaboration with and advise the Gaming Agents, Sports Wagering Division, and members of the GEU in preparing notices of violation(s) and enforcement actions, including the assessment of, or recommendations for, civil administrative penalties, to address casino and vendor noncompliance under the gaming law, as well as noncompliance by those who hold licenses under the sports wagering law.
  • Work with management of casinos and sports wagering operators to obtain information related to noncompliance matters and, in some instances, towards disposition of civil administrative penalties by way of agreed settlements.
  • Provide legal guidance to the Gaming Agents and Sports Wagering Divisions regarding the regulatory audits and monitoring functions performed by those Divisions; the ongoing review of the casinos’ and sports wagering operators’ Internal Controls to ensure consistency with all regulatory requirements; and in identifying and managing areas of risk.
  • Work in collaboration with the MGC’s General Counsel’s Office to identify and promulgate regulations and regulatory amendments to gaming and sports wagering regulations as necessary.
  • Maintain knowledge of the Massachusetts gaming and sports wagering laws, and issues that impact suitability for licensure of casino employees and vendors, as well as those who hold sports wagering licenses.
  • Work in collaboration with the MGC’s Licensing Division, the GEU, and the Financial Investigations Division, in performing the background investigations of sports wagering operators, as well as individuals and vendors who are seeking qualification or licensure for employment at, or selling goods and/or providing services to, the licensed casinos and sports wagering operators in Massachusetts.
  • Prepare and review suitability reports and/or summaries pertaining to high level casino employees, gaming vendors, and sports wagering operators as needed.
  • Work with IEB Paralegal(s) to prepare and review adverse action notices for applicants, licensees, and registrants who are disqualified or may be unsuitable for licensure or registration under Massachusetts law, as well as MGC involuntary exclusion list orders.
  • Prepare and present cases for hearings before an impartial hearings officer, including preparation and introduction of exhibits; witness preparation and examination; opening statements and closing arguments; and filing motions and briefs where necessary.
  • Present to the Commission in livestreamed public meetings and adjudicatory hearings.
  • Other duties as assigned.

Experience, Education, and Training:
  • A Juris Doctor degree from an accredited law school and a license to practice law in Massachusetts.
  • At least three to five years of legal experience working in a governmental agency or law firm, including trial or administrative hearing experience, or appellate experience.

The successful candidate must pass an extensive background check conducted by the Massachusetts State Police. It includes a full credit check, CORI (Criminal Offender Record Information), fingerprinting, drug test, reference checks, review of IRS Income Tax Transcripts for the last four years, and a Certificate of Good Standing from the Massachusetts Dept. of Revenue (DOR). The Massachusetts Gaming Commission is responsible for the implementation of the expanded gaming law (Chapter 194 of the Acts of 2011) and regulatory oversight of G.L. chapter 23K (casino gaming), chapter 23N (sports wagering), and chapter 128A (horse racing). Under these laws, the Commission is tasked with establishing a regulatory framework for the solicitation, licensing, taxation, and oversight of a maximum of three casino licenses and one slots parlor only license, the provision of in-person and digital sports wagering, and the live and simulcasting of horse racing in Massachusetts.
